[edit] Proprietary and Non Proprietary Research at BCSB Beamlines:

Proprietary Research: The Government and the University have no rights to the data generated by the user during proprietary research. Users performing proprietary research will be charged a fee based on cost recovery for ALS usage. In return, the user may take title to any inventions made during the proprietary research, retain results, and treat as proprietary all technical data generated during the beam time. Proprietary data is technical data which embody trade secrets, developed at private expense, which are not generally known or available from other sources without obligation regarding their confidentiality. Proprietary research is not intended for the open literature. Please note that the ALS assesses proprietary charges in eight-hour increments.

Non-Proprietary Research: For research to be considered non-proprietary, the research results are intended for publication in scientific journals. The ALS does not charge users for beam time if their research is non-proprietary.

Note: If your research includes both proprietary and non-proprietary work, you must meet the requirements for both as described below.

[edit] Proprietary Research at BCSB Beamlines:

Any researcher who would like to conduct proprietary research at BCSB beamlines must meet the following requirements:

  1. A fully executed ALS Proprietary User agreement must be in place prior to beam time.

  2. Proprietary funding must be received by LBNL at least five business days in advance of beam time.
  3. In advance of beam time, researchers must claim shifts as proprietary or non-proprietary. Claims should be submitted to ALS_BCSBaccounts@lbl.gov.

Please note that the ALS assesses proprietary charges in eight-hour increments.

Contract/Funding Verification: LBNL is required by DOE to obtain payment in advance for all proprietary usage. We cannot verify there is adequate funding in the user's proprietary account unless claims from users are submitted and reviewed before the beam time begins. If you have any questions concerning your proprietary account balance, please contact ALS_BCSBaccounts@lbl.gov.

Open Beam Time: Use of beamlines that have available time at short notice is strongly encouraged. When sending a request to reserve open beam time (BCSBBeamtime@lbl.gov), please claim the number of proprietary/non-proprietary shifts. BCSB admin staff will confirm that valid proprietary and/or non-proprietary contracts are in place, and that adequate proprietary funding is available. Use of "open" beam time without prior funding/contract verification is not permitted.

"Pending" Policy: If a user would like to reserve future beam time for use, but has no valid contract in place or inadequate proprietary funding in their account, the BCSB Scheduler will post their reservation request on the web schedules with "pending" after the User Name. Proprietary funding must be received by LBNL five business days prior to the scheduled beam time. If the funding has not been received by this time, or if the executed proprietary user agreement has not been received prior to beam time, the user will be required to re-schedule for a later date, as the reservation will be released and the beam time will be available for use by other users.

Unusable Beam Time: If a researcher is unable to complete their reserved shifts due to technical difficulties (i.e. beamline or storage ring malfunction), etc., please notify BCSBBeamtime@lbl.gov and the beamline scientist upon conclusion of your work.

Please include the time that you stopped work; if applicable, proprietary charges will be adjusted to reflect actual usage. Please keep in mind that the ALS assesses proprietary charges in eight-hour increments.

Any researcher who would like to conduct non-proprietary research at BCSB beamlines must meet the following requirements:

  1. A fully executed ALS Non-Proprietary User agreement must be in place prior to beam time.

  2. In advance of beam time, researchers must claim shifts as non-proprietary or proprietary. Claims should be submitted to ALS_BCSBaccounts@lbl.gov.

The ALS does not charge for non-proprietary research conducted on the beamlines.
